PTAB Rules against Nichia, Affirms Patent LED Patent Validity

The Patent Trial and Appeal Board (PTAB) affirmed a surface mount LED patent validity by Document Security Systems Inc.Nichia Corporation’s proposed construction of a key claim regarding the patent it had challenged to be invalid could not convince PTAB with its invalidity arguments. PTAB’s decision will help Document Security in a patent infringement lawsuit against Nichia in California.

The Patent Trial and Appeal Board (PTAB) has favoured BASF SE’s inter partes review (IPR) petition. BASF asserted in its IPR that Enthone, Inc.’s electroplating patent is too obvious for patent protection. PTAB ruled in favour of BASF and upheld its claims.
PTAB Rules NOCO’s Battery Jumper Patent as Ineligible

The Patent Trial and Appeal Board (PTAB) has ruled against The NOCO Company. PTAB found the claims challenged by a Chinese company against NOCO as obvious and ruled the ineligibility of NOCO’s patent. The disputed patent covers a portable car battery jump-starter. PTAB stated the ineligibility of the patent due to its similarity with older patents.
Mitsubishi Chemical Signed a Patent Licensing Agreement with Mitsui Chemicals

Mitsubishi Chemical Holdings Corporation has signed a biomass-based polyester patent licensing agreement with Mitsui Chemicals Inc. Biomass-based polyester is expected to encourage the reduction of greenhouse gas emissions. The patent is owned by Mitsubishi which is a basic patent required for business operations engaged in the manufacture or sale of this material. Mitsubishi has registered the patent in Japan, U.S., Europe, and China.
BASF Entitled to “Nominal Damages” as Carpmaels & Ransford delays IP Appeal Filing

The Chancery Division of the High Court judge has ordained Carpmaels & Ransford, LLP pay nominal damages due to omission of deadline for filing appeal for invalidating vehicle emissions treatment patent to BASF SE. The judge stated his dissent that the patent will enhance the chemical company’s profits.

Gevo Inc. has acquired certain patents of Butamax Advanced Biofuels LLC and its affiliate. The transaction is subject to particular existing rights and obligations that were observed by the Asset Purchase Agreement. It gives Gevo ownership, management and full rights to sublicense the isobutanol and isobutanol derivatives patent estate completely in the fields of fuels, isooctane, industrial chemicals, isobutylene, oligomerized isobutylene and para-xylene.
