CAFC Rejects Mobility’s Plea against PTAB’s Structure for Due Process

The U.S. Court of Appeals for the Federal Circuit (CAFC) has rejected Mobility Workx, LLC’s constitutional challenge against the Patent Trial and Appeal Board (PTAB). CAFC has affirmed that PTAB’s structure does not breach due process rights under the Constitution of the United States. CAFC found no evidence for financial interest of PTAB administrative patent judges (APJs) in initiating inter partes review (IPR) proceedings.
