SCOTUS Declines Hearing Case against USPTO Fees After Invalidation of Patents

The Supreme Court of the US (SCOTUS) has rejected a class action including a petition for certiorari by Christy Inc. filed against the US Patent and Trademark Office (USPTO). As per the petition, the USPTO violates the Fifth Amendment when it invalidates a patent but does not refund the patent fees to the owner. The petition was filed by Christy after the patent office invalidated a vacuum cleaner patent on challenge by Black & Decker Inc.
