Oki Data Americas, Inc. has requested the Supreme Court of the U.S. (SCOTUS) to deny the appeal for the review of the U.S. Court of Appeals for the Federal Circuit (CAFC). Infinity Computer Products, Inc. appealed SCOTUS in a certiorari petition to review whether CAFC has developed a new standard on indefiniteness.

PTAB Rejects GPS Lockbox’s Plea to Review NPI Patents

The Patent Trial and Appeal Board (PTAB) has refused GPS Lockbox’s appeal to review three National Products Inc.’s (NPI) patents related to docking sleeve. NPI has sued GPS for patent infringement in the U.S. District Court for the Western District of Washington. PTAB has disproved all the three pleas of GPS.

CAFC Finds Cisco’s Willful Infringement of SRI’s Patents

The U.S. Court of Appeals for the Federal Circuit (CAFC) revived a district court’s denial to reinstate a jury’s willful infringement verdict and enhanced damages in the SRI International Inc. vs. Cisco Systems. Considering willful infringement, it also asserted an attorneys’ fees award. The standard for induced infringement is different than that for willful infringement. CAFC found that the jury examined the evidence put forth by SRI as per the instructions on induced infringement. The court concluded that SRI was entitled to enhanced damages as Cisco was found to have willfully infringed on the asserted patents.

Broadcast TV Equipment Seller Appeals SCOTUS to Review its Patent Eligibility Case

ENCO Systems, Inc. has appealed to the Supreme Court of the U.S. (SCOTUS) to review the U.S. Court of Appeals for the Federal Circuit (CAFC) ruling over automated captioning technology patent. ENCO’s patent eligibility was denied in CAFC ruling against DaVincia, LLC which does business as Link Electronics. ENCO has claimed that its case is a better candidate for patent eligibility.

PTAB Nixes Two and Part of Third Tech Patent on Challenge by CoolIT

The Patent Trial and Appeal Board (PTAB) has axed challenged claims in two computer cooling patents belonging to Asetek Denmark A/S on challenge by CoolIT Systems Inc. However, the board only partly axed a third patent challenged by CoolIT. All the claims in the patents were invalidated on the basis of obviousness and some for being anticipated.

Massachusetts Judge Rules that Cisco Must Face Network Patent Lawsuit

As per a Massachusetts federal judge, Cisco Systems Inc. will have to face allegations that it infringed a virtual computer networks patent, although Egenera Inc. was responsible for some “sketchy” conduct during a trial. Cisco had stated that Egenera was guilty of “egregious” litigation misconduct as paid consultants falsely testified about the inventorship of the patent, thereby downplaying the contributions of an ex-Egenera employee.
