Raytheon Technologies Corp.’s en banc appeal against a ruling of the US Court of Appeals for the Federal Circuit (CAFC) has been rejected. The CAFC had ruled in favor of General Electric Co. allowing it to appeal against a Patent Trial and Appeal Board (PTAB) decision even though GE did not have any active infringement litigation involving the patent in question.

US Inventor Seeks to Block New Patent Challenges Until USPTO Implements Changes in Patent Review System

The inventor group US Inventor has urged the US District Court for the Eastern District of Texas to block the US Patent and Trademark Office’s (USPTO’s) tribunal, the Patent Trial and Appeal Board (PTAB), from accepting new patent challenges. The inventor group has asserted that the patent office needs to start the process of establishing new rules for PTAB’s denial of patent reviews before taking up new patent review petitions.

SCOTUS Declines Appeal against CAFC’s On-sale Bar Patent Invalidity Ruling

The Supreme Court of the US (SCOTUS) declined the review petition by GS Cleantech Corp. against a ruling of the US Court of Appeals for the Federal Circuit (CAFC). As per the ruling, patents belonging to the appellant were declared invalid based on the on-sale bar which deems a patent invalid if it is sold a year before the patent filing.

London IP Court Gets a New Judge

Senator Tillis Writes to Biden Advising Over Selection of USPTO Director

Senator Thom Tillis has written to the US President Joe Biden, advising him over the appointment of the new Director for the US Patent and Trademark Office (USPTO), replacing former director Andrei Iancu. In his letter, Tillis mentions that the new director should be someone like Iancu who was committed to bringing about administrative reforms and had a vision for the success of the office. Tillis went on to say that the new director must stress upon complete protection of intellectual property.

New US IP Subcommittee Chair Announced

The US Subcommittee on Intellectual Property will have a new chair to replace Senator Thom Tillis. Senator Patrick Leahy will now take Tillis’ place as the chair. Leahy is known to be the lead author of the America Invents Act.
