
Apple Challenges Plaintiff Over Ownership of Patents at Issue

Recently, two Federal Circuit judges questioned Apple Inc. on contract language at the heart of a dispute over whether Omni MedSci Inc. that filed a lawsuit against Apple for patent infringement owns the patents at issue. Omni had claimed that the Apple Watch infringed two of its patents on health-related sensors. However, Apple stated that Omni does not own the patents as the inventor who sold them to Omni had automatically assigned them as well as other future inventions to his ex-university employer.

DSM Wins Vitamin Patent Battle against Anhui Tiger

DSM, a prominent nutritional ingredients manufacturer, emerged victorious in a patent fight against Anhui Tiger Vitamin after the China’s Supreme People’s Court ruled in its favour. The dispute between the two companies was regarding the stereoselective synthesis of biotin. The court has ordered Anhui Tiger to stop use of the said synthetic route and pay damages to DSM.

Bayer Accuses Ecomed of Infringing on Two of Their Patents

Bayer AG has filed a patent infringement lawsuit against Ecomed Solutions LLC for infringement of two of their patents. Bayer has asserted that Ecomed infringes on their patents with the sale of the syringes designed for use with Bayer’s CT Injection System. The plaintiff seeks an award of damages arising from the infringement.

Minerva Files Brief against Assignor Estoppel Doctrine

Minerva Surgical Inc. has filed a brief against the Assignor Estoppel Doctrine with the Supreme Court of the US (SCOTUS). The appellant argues that the doctrine which bars an inventor from challenging a patent after selling it is ‘uncommonly lawless’ and that the SCOTUS should look into it.

CAFC Reverses Patent Validity Ruling by PTAB

The US Court of Appeals for the Federal Circuit (CAFC) found certain claims of a patent upheld by the Patent Trial and Appeal Board (PTAB) to be invalid due to obviousness and others to be reviewed by the board. The PTAB had upheld the claims of a skin cancer detection device patent belonging to Melanoscan LLC challenged by Canfield Scientific Inc.
