Federal Judge Rejects Allergan’s Bid to Escape FCA Lawsuit

Allergan Inc.’s bid to evade a False Claims Act (FCA) lawsuit has been rejected by a California federal judge. Joseph Spero, the US Magistrate Judge, decided that a patent attorney’s allegations that Allergan unfairly obtained dementia drug patents and intentionally asserted invalid patents to edge out rivals to maintain inflated prices of drugs are adequate to raise his FCA claims.
