European Patent Board Rules in Favour of Puma Biotechnology

The European Board of Appeals has reversed a decision by the European Opposition Division upholding a patent belonging to Puma Biotechnology Inc. The patent relating to the method of using irreversible EGFR inhibitors for cancer treatment was challenged by a unit of Boehringer Ingelheim Group. Appeals Board ruled that the opposition to the validity of the patent could not be accepted.
