Garmin and Fitbit Urge Acceptance of Patent Review Even as ITC Case Goes On

Garmin Ltd. and Fitbit Inc. have urged the Patent Trial and Appeal Board (PTAB) to not apply the fintiv precedent in a patent complaint that the US International Trade Commission (ITC) is investigating. The companies presented in their argument to the Precedential Opinion Panel (POP) that an inter partes review appeal should not be rejected on discretion by the PTAB on the basis of a pending ITC investigation since the trade commission body cannot invalidate patents.
