
Court Denies Recent Attack on PTAB’s Discretionary Denials

The District Court has denied recent attacks on the Patent Trial and Appeal Board (PTAB)’s discretionary denials. The judge stated that they were affected in such a way that allows for a lawsuit. It further said that it was affected due to the U.S. Patent and Trademark Office (USPTO)’s NHK-Fintiv rule and the problem could have been resolved with an injunction against the rule. The District Court has upset opponents of NHK-Fintiv including Apple, Inc. and Google, LLC but Big Tech is also attempting to undo the lancu policy on Capitol Hill.

Beijing IP Court Welcomes First Drug Patent Linkage Litigation Case

The Beijing Intellectual Property Court declared that it welcomed its first drug patent linkage litigation case. The China National Intellectual Property Administration (CNIPA), an alternative patent linkage adjudication mechanism, announced that they have received 12 cases. China implemented a patent linkage system in their amended patent law which will block marketing consent of generic drugs until after the expiration of patents covering the drugs or uses.

Chongqing, Chinese Court Asked to Set Global FRAND Rate

The Chongqing Court has been asked to set up standard essential patent (SEP) license terms after a ruling by the English Court in the Guangdong Oppo Mobile Telecommunications Corp., Ltd. and Nokia Corporation dispute.

CNIPA Discards Half Million Patent Applications as “Abnormal”

China’s National Intellectual Property Administration (CNIPA) is striving to clear out the country’s patent system. In quality elimination, CNIPA flagged 545,000 patent applications as ‘abnormal’. A large number of Chinese patent filings were restrained and the owners were given an opportunity to take back the applications or present evidence that they are legitimate.

Cipher, Unified Patents, RPX Corporation, Aon plc and Google Patents will be providing the standardized patent identification format (SPIF) through their platforms. SPIF, a concept and invention of partnership between Richardson Oliver Insights, Cipher, Unified Patents, RPX and IAM is designed for more efficient patent transactions and portfolio management. It is to make the process of identifying assets when they are bought, sold or managed in a portfolio easier.

China to Double the number of Foreign Patents Granted Annually, Releases 14th Five Year Plan Notice on IP

The 14th Five Year Plan Notice of National Intellectual Property Protection and Utilization Plan was released by the China’s State Council. The main objective of the IP plan is to double the number of foreign patents granted annually and by increasing the number to double of “high-value” patents per 10,000 people. China is planning to achieve this goal by 2025.
