Massie Presents Bill to Repeal PTAB to Return to “First-to-invent” Model

The U.S. Representative Thomas Massie has presented a bill “Restoring America’s Leadership in Innovation Act of 2021 (RALIA)” to revoke the Patent Trial and Appeal Board (PTAB) and reestablishment of the Board of Patent Appeals and Interferences. Massie has insisted on returning to the “first-to-invent” model rather than “first-to-file”. The bill is supported by the inventor groups.
German Parliament Updates Patent Act, Green Signal to UPC

The German Parliament has updated a bill to revise the Patent Act to simplify and streamline the law and to expedite patent proceedings. The revision will bring clarity in areas of patent law, intellectual property (IP) protection and FRAND licensing. The UPC Preparatory Committee has stated that the UPC Agreement is updated and will come into force in mid-2022.
KIPO to Consider AR, VR Videos’ Eligibility for IP Protection

The Korea Intellectual Property Office (KIPO) has stated that virtual reality (VR), augmented reality (AR) videos, images on websites, street walls and human bodies will be considered eligible for the intellectual property (IP) registration in South Korea. The revision to related laws will be applicable from Thursday.
The U.S. Patent and Trademark Office (USPTO) is ready to enhance patent diversity and inclusion under the Inventor Diversity for Economic Advancement Act (IDEA Act). USPTO will collect voluntarily provided information on “gender, race, military or veteran status, and any other demographic category related to each inventor listed with an application for patent” as suggested in the act. The data will aid in strategizing ways and encouraging diverse inventorship.
USPTO’s Acting Chief to Start Reviewing PTAB Decisions

The US Patent and Trademark Office (USPTO) has announced that it will not wait for the permanent Director of the office to be appointed and that the acting chief Drew Hirshfeld will start reviewing the decisions of the Patent Trial and Appeal Board (PTAB). The decision follows the ruling of the Supreme Court of the US (SCOTUS) which enabled the patent office director to review the decisions of the patent tribunal
USPTO Reveals Steps for Director’s Review of PTAB Decisions

The US Patent and Trademark Office (USPTO) has revealed that the Director of the office can review a decision of the Patent Trial and Appeal Board (PTAB) on their own or on the request of an involved party. The procedures for the review were revealed after the Supreme Court of the US’ (SCOTUS’) decision for the USPTO director’s need to review decisions made by the Administrative Patent Judges (APJs) of the board.
