Bill Introduced to Limit Legal Action by Patent Licensing Companies

Representatives Suzan DelBene and David Schweikert of the US House of Representatives reintroduced a bill aimed at reigning in patent licensing companies from filing complaints at the US International Trade Commission (ITC). The Advancing America’s Interests Act was not able to hold ground when it was first introduced. However, the bill aimed at helping American companies was hailed by tech giants.
Brazil Gets a Law to Break Patents in Case of Emergency

The President of Brazil, Jair Bolsonaro has signed off on a law which allows the breaking of patents in cases of emergency. As per the law, patents for medicines and vaccines can be overridden if there is an emergency, such as the COVID-19 pandemic.
The United States Patent and Trademark Office has updated its guidance on carrying out the U.S Supreme Court’s decision that enabled its director to conduct a review of decisions made by the Patent Trial and Appeal Board. According to the interim process announced by the agency, the director can review a PTAB decision on the validity of a patent on its own or upon being requested by the parties. The update further clarifies the scope of review requests and explains that how the agency needs to handle them.
The Patent Trial and Appeal Board’s decision in the Amazon.com Inc. vs. Uniloc Luxembourg S.A. case has been designated as precedential. The ruling is about the non-preclusion of raising or considering other grounds of unpatentability by the petitioner or by the board.
