Patent Holder Asserts CAFC Decision Will Lead to More IP Suits

Patent holder PerDiemCo LLC has urged for an en banc review of a decision by the US Court of Appeals for the Federal Circuit (CAFC) which allowed alleged infringer to sue for non-infringement. The appellant told the court that if the decision is not reversed, more companies will be encouraged to file for non-infringement lawsuit against companies offering licenses rather than negotiating deal terms, as Trimble Inc. allegedly did in this case.
