PTAB Sides with Pfizer Again

Following a remand order by the Court of Appeals for the Federal Circuit (CAFC), the Patent Trial and Appeals Board (PTAB) has once again ruled in favour of Pfizer Inc. by upholding their pneumonia vaccine patent claim for Prevnar 13. The board asserted that the patent challenger Merck & Co., Inc. was not able to prove the patent invalid on grounds of obviousness as claimed by them.
