
PTAB Refuses Patent Review Petition by Black & Decker

The Patent Trial and Appeal Board (PTAB) has declined the petition for review of two patents relating to stud finders, which are part of a patent infringement investigation at the US International Trade Commission (ITC) concerning Stanley Black & Decker Inc. tools. The board turned down Black & Decker’s appeal for review of Zircon Corp.’s patents noting that the ITC’s investigation is anticipated to be completed nearly two months before the board would release its review decisions.

CAFC Partly Affirms Partly Reverses PTAB’s CBM Review Ruling

The US Court of Appeals for the Federal Circuit (CAFC) partly affirmed and partly reversed a covered business method (CBM) review by the Patent Trial and Appeal Board (PTAB). The court stated that the invalidity ruling for the customer loyalty program patent was right as challenged by cxLoyalty Inc., but the substitute claims constructed by Maritz Holdings Inc. should also have been rejected as invalid.
