CAFC Refuses Issuance of Mandamus Petition to G&H, Says the Petitioner Fails to Meet the Required Standard

The U.S. Court of Appeals for the Federal Circuit (CAFC) has denied G&H Diversified Manufacturing, LP’s mandamus petition. G&H has appealed to the U.S. District Court for the District of Texas for transferring its patent dispute with DynaEnergetics Europe GmbH & Co.KG and DynaEnergetics U.S., Inc. to another court in Texas. CAFC has refused G&H’s plea stating that the petitioner has failed to meet the stipulated standard for the issuance of mandamus. The dispute is related to patent infringement by G&H related to perforation gun system components used in oil well drilling operations.
PTAB Invalidates Several Claims in Raytheon Jet Engine Patent

The Patent Trial and Appeal Board (PTAB) has invalidated several claims in Raytheon Technologies Corp.’s jet engine patent due to obviousness after a challenge raised by General Electric Company. The board ruled invalidation after a remand order from the U.S. Court of Appeals for the Federal Circuit (CAFC) after finding five claims related to patent as unpatentable.

The Patent Trial and Appeal Board (PTAB) has invalidated claims in a patent belonging to Samsung SDI. The board found that all the challenged claims of the lithium-ion patent were invalid on the basis of being overly broad and restrictive as asserted by challenger Ascend Performance Materials.
PTAB Declines Canadian Solar’s Patent Review Petition against Solaria

The Patent Trial and Appeal Board (PTAB) has rejected a petition for reviewing a solar cell patent by Canadian Solar Inc. against Solaria Corp. The board used its discretion to reject the patent review petition based on the fact that a parallel investigation is on-going at the US International Trade Commission (ITC) and is expected to end before the board can give its ruling.
Magistrate Judge Recommends Dropping Several Defendants from MEEC Patent Infringement Lawsuit

The magistrate judge at the US Court for the District of Delaware has recommended that 12 defendants fighting patent infringement charges brought by Midwest Energy Emissions Corp. (MEEC) be dropped from the litigation. The reason provided by the magistrate judge to drop these defendants including Arthur J. Gallaher & Co., DTE REF Holdings LLC and others is that they have not been given clarity on how they infringe on the asserted patents. Notably, requests from 16 other defendants for being cleared of charges has been declined by the judge.
