Alcon Files Lawsuit Over Eye Allergy Patent Infringement in a Delaware Court

Alcon Inc. and Alcon Laboratories Inc. have filed a patent infringement lawsuit over Pataday eye allergy treatment in U.S. District Court for the District of Delaware. Alcon requested for an injunction that would prohibit Somerset Therapeutics LLC, Somerset Pharmaceuticals, Inc. and Odin Pharmaceuticals, LLC from selling the proposed generic version of Alcon’s Pataday.
A Georgia Court Transfers Medical Device Patent Dispute to Maryland

The U.S. District Court for the Northern District of Georgia declined to dismiss a patent suit concerning needle guides used in prostate cancer screening. The lawsuit is between Corbin Clinical Resources, LLC and Advance Medical, Inc. The court also transferred the dispute to Maryland because of jurisdiction issues.
CAFC Commands WDTX Judge to Transfer another Patent Suit to California

The U.S. Court of Appeals for the Federal Circuit (CAFC) has ordered the U.S. District Court for the Western District of Texas judge to transfer the patent lawsuit between Ravgen, Inc. and Quest Diagnostics, Inc. from Western District of Texas to the U.S. District Court for the Central District of California. CAFC reaffirmed that Western Texas judge abused his discretion by refusing the transfer of the patent dispute.
USPTO Rejects J&J’s Review Plea for Eye Surgery Patents

The U.S. Patent and Trademark Office (USPTO) declined the request of Johnson & Johnson Surgical Vision Inc. to review Alcon Laboratories Inc.’s 2 patents on lasers used in cataract surgery. The ongoing lawsuit between both parties is related to patents where both sides are claiming the other of patent infringement. USPTO stated that it had already addressed the claims and refused J&J’s petition to review Alcon’s patent.
Splash Medical Devices Sues ZeroWet Over Wound Irrigation Shields Patents

Splash Medical Devices, LLC has filed patent infringement litigation against ZeroWet, Inc. in the U.S. District Court for the Central District of California. The plaintiff has accused the defendant for infringing its two patents related to the SplashCap, wound irrigation shield.

The U.S. Court of Appeals for the Federal Circuit (CAFC) confirmed Abbott Laboratories’ win. CAFC upheld the U.S. Patent Trial and Appeal Board’s (PTAB) decision to invalidate a FlexStent, LLC patent for an expanding heart stent. Abbott’s vascular unit challenged the lawsuit filed by FlexStent in the U.S. District Court for the Central District of California. PTAB found that that vascular stents with a structure similar to what’s covered by the patent were renowned.
