USPTO Solicits Public Comments on a Formal Notice-And-Comment Rulemaking Process

Early this week, the US Patent and Trademark Office (USPTO) published a request for comments in the Federal Register. The request relates to whether the agency should start a formal notice-and-comment rulemaking process, which will be directed towards how the Patent Trial and Appeal Board (PTAB) uses its discretion in deciding whether to institute an Leahy-Smith America Invents Act (AIA) trial.
