Court Denies Recent Attack on PTAB’s Discretionary Denials

The District Court has denied recent attacks on the Patent Trial and Appeal Board (PTAB)’s discretionary denials. The judge stated that they were affected in such a way that allows for a lawsuit. It further said that it was affected due to the U.S. Patent and Trademark Office (USPTO)’s NHK-Fintiv rule and the problem could have been resolved with an injunction against the rule. The District Court has upset opponents of NHK-Fintiv including Apple, Inc. and Google, LLC but Big Tech is also attempting to undo the lancu policy on Capitol Hill.
