Facebook’s En Banc Plea Rejected by Third Circuit in News Anchor Row

The U.S. Court of Appeals for the Third Circuit denied Meta Platforms Inc. formerly Facebook Inc.’s en banc plea for a full-court review regarding the intellectual property (IP) claim by Good Day Philadelphia co-anchor Karen Hepp. Karen had filed a lawsuit against Facebook for unauthorized use of her photo on its site. The decision of the Third Circuit maintains the panel’s split decision in favor of the television anchor ruling that the Communications Decency Act allows state law IP claims to continue regardless of the broad immunity Big Tech companies can use to resist lawsuits over site content.
