Change in Order of Criterion Review for Patent Issuance Could Be Implemented by USPTO

The acting head of the US Patent and Trademark Office (USPTO), Drew Hirshfeld has stated that the office is considering the advice of two senators to change the order in which the examiners consider the factors before patent issuance. As per the revised order, the patent eligibility of an invention may be checked at the end, though Hirshfeld does not personally believe the change in the process may have an impact on issuance of patents in some cases.
